There is no misleading behaviour in related business operations if there is no possibility that people doing business will be deceived by statements in advertisements. To avoid deception in relevant business operations, supplementary information should be provided.
The above decision stands in contrast to the â€Frankfurt - Hahn†case (cf. Higher Regional Court Cologne, file no. 6 U 68/02) where the parties agreed to settle the case in court by mutual settlement declaration after the court had held that a deception in business operations was not evident as there had been numerous reports in the media about “Frankfurt - Hahn†airport being located approximately 100 kilometres away from Frankfurt am Main.
As opposed to this, Weeze airport (the formerly British RAF Airport Laarbruch) was deemed not to be as well known as Frankfurt - Hahn airport. Thus, the local court in Cologne assumed that a deception of flight guest would still be possible with respect to Weeze airport.
