In a newly published judgment from September 2005, the BGH has now ruled that undertakings are allowed to advertise that they e.g. support environment protection. In the case in question, a manufacturer of eye glasses had stated in a newspaper ad that it supported an environment protection organisation. In the opinion of the BGH, such a reference does not influence the consumer’s choice for the product in an inappropriate way. A statement in an advertisement appealing to the social responsibility of the consumer was not in itself unfair because the statement was connected with the advertised product. Recently such image campaigns have begun to appear more often in Germany, for instance in connection with a beer advertisement stating that a certain amount of the purchase price of each crate of beer will be donated to environment protection projects.
