The "Schrems II" decision of the European Court of Justice (ECJ): "Privacy Shield" between EU and USA invalid - what now applies to international data transfers?

In a decision published 16.07.2020, the European Court of Justice (ECJ) has ruled the "Privacy Shield" agreement on data transfer between the EU and the USA invalid. Although standard contractual clauses (SCCs) remain a possible solution for securing such data transfers, companies must also comply with the requirements of the ECJ when using SCCs.

Please find further information on the case and recommended actions for your company in our enclosed newsletter.

We would be happy to support you and your company in implementing the new legal requirements for international data transfer. Please contact us!
